There were 29 members present.  &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;2009 Budget:&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;A discussion was held on the 2009 Budget that was approved by the 2008 Trustees and sent out to the homeowners in the mail prior to the meeting.  In 2008 5% was held in reserve for delinquent fees.  Because of the economy and the many foreclosures 10% is being held in reserve for 2009.&lt;br /&gt;&lt;br /&gt;The new landscaper contract should save the homeowners approximately $3500 for 2009. The irrigation costs increased slightly, but most of the items are in the same range as 2008.  &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Past Due Accounts:&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;It is part of the function of PSAM to know the names of who owes annual dues and fees.  The Trustees do not know those who are delinquent in payments.  Lisa Pearson summarized the amounts that are owed and that are in the process of trying to collect.&lt;br /&gt;&lt;br /&gt;20         between          $100 - 200&lt;br /&gt;&lt;br /&gt;2          between          $200 – 300&lt;br /&gt;&lt;br /&gt;4          between          $300 – 400&lt;br /&gt;&lt;br /&gt;9          between          $400 – 500&lt;br /&gt;&lt;br /&gt;3          between          $500 – 600&lt;br /&gt;&lt;br /&gt;3          between          $600 – 700&lt;br /&gt;&lt;br /&gt;3          between          $700 – 800&lt;br /&gt;&lt;br /&gt;1          between          $800 – 900&lt;br /&gt;&lt;br /&gt;2          between          $900 – 1000&lt;br /&gt;&lt;br /&gt;7          over                 $1000&lt;br /&gt;&lt;br /&gt;May have to determine whether to write-off fees owed from any foreclosures.  In some cases HUD has picked up the fees owing to associations.  Some of the fees owed include a number of late fees at $25 each.  Warning letters are sent out along with a late fee assessment.  Action from small claims court can be taken.  As a last resort action, wages can be garnisheed.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Recommendations for 2009&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;The Trustees have initiated a contract for the repair and proper replacement of the rock wall at the entrance to Phase II at Solomen Run Road .&lt;br /&gt;&lt;br /&gt;Currently in contract is a section of fencing on Waggoner Road, north of Solomen Run – south of Waggoner Chase Blvd.   Fence is being constructed to connect the current fencing.  Trees can be planted later.&lt;br /&gt;&lt;br /&gt;Planting flowers at the entrances did not get done in 2008.  We had no volunteer group as in 2007.  There is an allocation in the landscaper’s contract for seasonal plantings which may include flowers.  This needs to be better defined as to comprehensive plantings.  A discussion was held on how the members could help get the planting done for 2009.&lt;br /&gt;&lt;br /&gt;The repainting of the entrance signs are in contract and are in the process of being painted.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Old Business&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;The Trustees had put the Harley Run gazebo project on the back burner because there were other issues that took a higher priority.  There is still a possibility to build a gazebo in the future.&lt;br /&gt;&lt;br /&gt;Phase II walkway from Benhower Street to the Harley Run community green area was discussed.  A new option to build the walkway along Waggoner Road might be a better and safer alternative.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;New Business&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Election of 2009 Trustees:  Lisa Pearson, PSAM conducted the election.&lt;br /&gt;&lt;br /&gt;Tom Magin nominated Jim Justice.  Jim declined.&lt;br /&gt;&lt;br /&gt;Jim Justice nominated Tom Magin. Tom accepted.&lt;br /&gt;&lt;br /&gt;Andrew Callahan nominated Mike Duane. Things to be considered:&lt;br /&gt;&lt;br /&gt;1. Legal fees for collection of delinquencies&lt;br /&gt;&lt;br /&gt;2. Integrity issues (could the Trustees be unbiased with making decisions on what could be personal issues brought up by disgruntled homeowners?)&lt;br /&gt;&lt;br /&gt;3. Can be very time consuming&lt;br /&gt;&lt;br /&gt;4. To our knowledge, this is the first increase in fees since incorporation as an association in early 2000. &lt;br /&gt;&lt;br /&gt;For the State of the Association, we’ll present the following:&lt;br /&gt; &lt;br /&gt;• Association budget for 2009,&lt;br /&gt;&lt;br /&gt;• status of past-due accounts – in general terms only – no names,&lt;br /&gt;&lt;br /&gt;• our recommendations for beautification of Waggoner Chase for the coming year.&lt;br /&gt;&lt;br /&gt;The election of Trustees for the coming year will be the last item on the agenda. &lt;br /&gt;&lt;br /&gt;Two of the present trustees, Andrew Callahan and Richard Kee, have submitted their candidacy for reelection for the coming year and have agreed to serve if reelected. David Dye from PSAM was also present.&lt;br /&gt;Richard Kee reported on the following:&lt;br /&gt;Financials - Our Association finances are in good standing with $30K+ in savings. It is common practice to have a full year’s budget in reserve.&lt;br /&gt;&lt;br /&gt;Gazebo - We’re looking at early summer before the gazebo will be built. The construction company needs a 10 week lead-time and then an additional four weeks for actual construction.&lt;br /&gt;Krista Greenlee suggested we look into having her father-in-law bid on the project. He has done a number of deck and fencing projects for other homeowners in our complex. The name and company: Joe Evans, Custom Fencing &amp; Decks 614-833-5400.&lt;br /&gt;&lt;br /&gt;Landscaping - The trustees are moving forward to having the drainage problem north of Waggoner Chase Boulevard eliminated by having it excavated or backfilled and relocating the irrigation system to a more protected area. The projected cost is ~$2700.&lt;br /&gt;&lt;br /&gt;Future Projects - Upgrading the lights at all five (5) entrances. FYI … The association owns the lights at the entrances and is responsible for the electricity used. Individual street lights within the association are owned by the City of Columbus which also pays for the electricity for those lights.&lt;br /&gt;Website - The website is down and out for the count. Richard accepted the help of Andrew Callahan who volunteered his services to set up a new site and be webmaster. Karen Kauffman will coordinate with Andrew to get the site up and running again.&lt;br /&gt;&lt;br /&gt;Entrance Signs - The rock walls/sign verbiage at the entrances are in need of repair and repainting of letters. The rock stones at Solomen Run need to be reset.&lt;br /&gt;&lt;br /&gt;Trees - The leaning tree at the north entrance to Waggoner Chase is to be removed and the stump “grubbed out,” along with the corresponding one across from it on the south side of the road.&lt;br /&gt;&lt;br /&gt;Christian Olson suggests that the Association talk with the City of Columbus about adding sidewalks along the main roads around the complex. The concern express by many in attendance is of safety issues with the increase of traffic to the area.&lt;br /&gt;&lt;br /&gt;Andrew Callahan expressed a concern about the new shops at Kennedy and Waggoner Roads. There is a problem with kids cutting through yards of those homes backing up to the retail property. The shops only have dim lighting which could allow for vandalism, graffiti and trash build-up in the area in back of the shops. Some homeowners have installed four-foot fences (the regulated requirements of the by-laws), however David Dye informed the Association that when yards are butted up against retail development property, variances may allow for a six-foot fence to be installed, at the discretion of the trustees. The Association will assess what we can do as an association to help out those who have already erected the four-foot fences to change them to six-foot fences.&lt;br /&gt;&lt;br /&gt;Randy Russell requested clarification of the payment of annual dues deadline. In the past the dues were due to be paid in January which proved to be difficult for many right after the holiday season. Finally, the timing has been moved back to March of each year to coincide with the annual association meeting which is stated in our by-laws to be the last Monday of March.&lt;br /&gt;&lt;br /&gt;A lengthy discussion was held on the large number of empty homes in the subdivision caused by either foreclosure or abandonment. The yards are overgrown and trashy. Doug Weaver, Trustee, suggested that the neighbors look for tags on the foreclosed homes which may have contact information of the companies that are holding the interest in the homes. Also HUD may have tagged the homes for foreclosure. He had done this and had gotten results in getting the yards cleaned up. In order to keep the neighborhoods looking good, some neighbors have taken upon themselves to mowing the yards themselves. If the yards become so overgrown the City of Columbus can be called to assist in the cleanup, especially if the yards pose a health problem. If en empty lot needs attending to, then contact PSAM and they will take care of getting it done by the developers. Kim Ebright expressed her concern about the broken windows in some of the foreclosed homes. This can be resolved by contacting the names on the tagged home. There is a home on Harley Run that had been condemned by the City of Columbus because of fire damage. David Dye, PSAM, will investigate the city’s destruction schedule.&lt;br /&gt;&lt;br /&gt;Fred Harrison expressed a concern about the landscaping company workmen have damaged and broken his fence when they are mowing the greenspace areas. Richard Kee will contact Chad from the landscaper and follow up in getting this problem corrected.&lt;br /&gt;&lt;br /&gt;Kim Ebright states that since the house next door to her has been built, the water in her yard no longer drains to the drainage ditch correctly. She needs to know what steps she must take to get the situation resolved. Richard Kee will see what needs to be done.&lt;br /&gt;&lt;br /&gt;CiCi Adams asked whether the trustees hold a paid position. The answer is not. It is strictly a volunteer position.&lt;br /&gt;Gazebo - Homeowners requested the background on how the decision for building a gazebo came about. Trustee, Richard Kee, explained as follows:Three years ago a committee was formed to develop ideas of what to do with the green space called “The Park” on Harley Run. They followed the guidelines of something private, attractive and that could tie in to a playground area. Overwhelmingly they came up with the gazebo idea. In the order of their importance these ideas came into play as phases.&lt;br /&gt;&lt;br /&gt;Phase 1. Fence – done 2007&lt;br /&gt;Phase 2. Trees – done 2007&lt;br /&gt;Phase 3. Gazebo - 2008&lt;br /&gt;Phase 4. Playground – timing TBD&lt;br /&gt;&lt;br /&gt;David Dye suggested we move forward with the annual trustee election. Pre-nominated were the current trustees, Richard Kee, Doug Weaver, and Karen Kauffman. Nominations from the floor were Ralph Moore and Andrew Callahan.
